Topographies of Semiconductor Products

– Law No. 2001-20 of February 6, 2001, on the Protection of Layout Designs of Integrated Circuits.

Protection

Applicant: creators who are nationals or have their domicile or place of business in Tunisia, their assignee(s) and the nationals of a country that ensures reciprocity to Tunisian nationals are entitled to protection.

Foreigners: appointing a resident agent is compulsory.

Filing conditions: the topography should be filed within two years of its first commercial use.

Scope of protection: includes protection against: (a) copying of the topography; (b) the use or importation for commercial use of any copy of the topography or of any semiconductor product including the topography.

Duration: ten years after the date of filing or the first commercial use.

Filing requirements for an application (to be sent to resident agent):
1. Power of attorney;
2. Copy of a drawing of the layout design.

Examination and Opposition

Examination: only formal.

Opposition: to be filed within one month from the litigious decision.
