Filing and Protection

Applicant(s): inventor(s) or assignee.

Protection for foreigners and nationals not living in the country: applicable.

Naming of the inventor(s): compulsory.

Types of patents: patents of invention and patents of addition.

Exclusion: inventions violating public order.

Novelty: compulsory; the invention must be deposited before publication or sale of the invention in the West Bank of Jordan.

Novelty grace period: not determined.

Exceptions to protection: pharmaceuticals, computer software.

Filing requirements for an application (to be sent to resident agent):
1. Power of attorney, notarized and then legalized up to the concerned Palestinian Consulate (or in its absence to the Jordanian Consulate);
2. A legalized Patent Form No. 1 sworn and signed by the inventor(s) as applicant(s), or jointly by the inventor(s) with other person(s) as applicants. If priority is claimed, the form should be signed by the applicant or by his successor in the home country, and legalized up to the concerned Palestinian Consulate (or in its absence to the Jordanian Consulate);
3. 3 copies of the specification in the English and Arabic languages. The last page of each copy of the specification should be dated and signed by the applicant(s);
4. 3 sets of the formal drawings, if any.

Note: all documents must be submitted at the time of filing.

Electronic filing: not available. 

For a change of name or address:
1. Power of attorney, notarized and then legalized up to the concerned Palestinian Consulate;
2. A notarized change of name or address certificate and then legalized up to the concerned Palestinian Consulate;
3. The patent registration's particulars including the title, filing date, registration date and registration number, inventor's name and applicant's name.

For an assignment:
1. Power of attorney, notarized and then legalized up to the concerned Palestinian Consulate;
2. A notarized deed of assignment and then legalized up to the concerned Palestinian Consulate;
3. The patent registration's particulars including the title, filing date, registration date and registration number, inventor's name and applicant's name.

Examination: as to formalities only.

Amendments: not applicable, should be filed as a new patent application.

Divisions: not applicable.

Appeal: possible within one month from the date of decision by the Registrar.

Publication: granted patents are published in the Official Gazette.

Opposition: possible, within two months as of publication of acceptance.

Delivery of document: the patent certificate is issued in paper format.

Duration: sixteen years from the filing date.

Annuities: are due before expiration of the 4th, 8th and 12th years of the validity period counting from the filing date.

Annuity grace period: one, two or three months, with fine.

Assignment: possible.

License: possible.

Marking – text of marking: no requirement.

Working: no requirement.

Compulsory license: may be granted upon an application by any interested party proving to the satisfaction of the Registrar that the reasonable requirements of the public have not been satisfied.

Cancellation – nullification: possible before the court.

Infringement and penalties: possible as per the law.

Enforcement: possible.
