Domain Names

There is no specific legislation although some regulations on the organization and management of country code top-level domain names do exist, for example NIC Chile Regulations on Chilean country code top-level .cl.  (New Regulations entered into force as of December 1, 2013.)

Filing

Country code top-level domain name: .cl 

Sub-domains: none.

Applicant: individuals and legal entities. 

Restriction as to nationality: none. 

Local presence: not required. 

Domestic trademark right: not required for obtaining domain name registration. Applications regarding a prior registered trademark owned by a third party shall be rejected. 

Domain name can be registered as a trademark: yes.

Registration, Protection

Granting: according to the new Regulations, all .cl domain names applied for are granted immediately upon payment of the official fees. 

Duration: one to ten years.

Renewal/maintenance: one to ten years, renewable.

Dispute about ownership: in case of conflict, the same is brought by NIC Chile before an arbitrator. 

Uniform dispute resolution procedure: none, but an administrative procedure other than UDRP is available before NIC Chile. The new Regulations developed by NIC Chile give two opportunities to object an already granted domain name. The first revocation action is available within thirty days as from the registration date, and such an action is to be grounded on “preferential interest”. Upon expiration of such term, a revocation action is still available, with no term, on the basis of “abusive registration”. The new procedure is prosecuted online and deadlines are extremely short (five days for paying arbitration fees; ten days for filing revocation actions or answering the same, including proofs, etc.).
