Protection

Definition: a trade secret is any commercial information, know-how and technological information which: (1) is secret in the sense that it is not, as a whole or in its precise configuration and assembly of its components, generally known among or readily accessible to persons within the circles that normally deal with the kind of information in question; (2) has commercial value because it is secret; (3) has been subject to reasonable measures under the circumstances, by the person lawfully in control of the information, to keep it secret.

Criteria for enforcement: the owner of the trade secret must take reasonable steps to keep the information secret.

Assignment - licensing: not available.

Remedies for misappropriation: compensation for damages and lost profits; ceasing or prohibition of the use or disclosure of the trade secret; destruction of all or part of documents, items, materials, substances or electronic documents that contain or carry the trade secret; prohibiting the offering of goods or provision of the services that are substantially favorably affected; seizure and destruction of trade secret infringing goods.
